1. Chuck’s Coin (the “seller”) retains all legal right, title, and interest in merchandise or property described until seller receives payment in full from buyer, customer, or client.
2. Seller shall not be deemed to have been paid in part or in full until any check has cleared through normal banking channels and has been deposited into seller’s account.
3. Buyer shall make payment to seller not later than 7 days after order. Any payment not received within 15 days shall incur finance charges and/or interest from buyer to seller for the balance due at the then current legal rate for the State of California or 10 percent compounded interest, which ever is higher.
4. This Agreement shall be subject to the laws of the State of California. Any legal dispute arising from this Agreement or the performance thereof shall be resolved by the filing of an action in the Superior Court for Shasta County, State of California. Seller and buyer agree that the proper venue for the resolution of any such dispute will be the Shasta County Superior Court.
5. This Agreement constitutes the entire Agreement between the parties and any and all other, further or prior agreements, promises, representations, and warranties are hereby deemed to have been merged herein and shall be of no force or effect. This Agreement can only be modified in writing.
6. Buyer, customer, or client, by agreeing to the transaction made the subject of this Agreement also agrees that he/she has read, approved, and agreed to the terms and conditions as set forth herein and agrees that those terms and conditions shall be a part of the Agreement between the parties.
